Terms of Service

These terms are an agreement between you and AIEngageTech, LLC ("Atested"). They govern your use of the Atested product, atested.com, and related services. By using any of them, you agree to these terms.

Atested is provided as-is. We make no warranties about fitness for a particular purpose, reliability, accuracy, or suitability for any specific use case. Atested is a governance product, but it is not a substitute for sound engineering judgment, legal advice, or compliance certification. If your use of Atested has legal or regulatory implications, consult appropriate professionals.

You may use Atested for lawful purposes consistent with the Acceptable Use Policy. You may not use Atested to create fraudulent records, manipulate audit trails, misrepresent what an AI agent did, or for any purpose that would itself violate law or a third party's rights.

Atested is source-available under the Business Source License 1.1. Personal non-commercial use, evaluation and testing, qualifying academic and research use, and non-production development are permitted by the Additional Use Grant. Any commercial or organizational production use—including entirely internal use by a business, nonprofit organization, government body, consultancy, or other organization—and any provision of Atested governance functionality to a third party requires a paid commercial license.

A paid license covers permission for the commercial or organizational production use described in the applicable order and the selected product tier's features, capacities, support, communications, and services. Product-tier machine limits and feature gates are product entitlements, not restrictions in the BSL itself. The selected plan and checkout terms apply in addition to these Terms.

Subscription renewal

Unless an applicable order expressly states otherwise, each self-service paid Atested plan is an annual subscription. Your subscription renews automatically for successive one-year terms until canceled. At renewal, Stripe will charge your saved payment method the then-current applicable price, unless Atested expressly promised a fixed renewal price in your checkout or order. Atested will provide any advance renewal or price-change notice required by applicable law or the applicable checkout terms.

Cancellation

You may cancel through the Stripe Customer Portal using the billing-management link available at atested.com/account/. If you cannot access the portal, submit an account or billing request at atested.com/contact/ using the email associated with the purchase. Cancellation must be completed or received before the next renewal date to prevent the next annual charge. Cancellation takes effect at the end of the current paid term, prevents future renewal charges, and does not reduce your paid access or entitlements during the remainder of that term.

Refunds

Except where required by applicable law or expressly approved by Atested, payments are non-refundable, and Atested does not provide refunds or credits for a partially used subscription term. Atested will review verified duplicate or erroneous charges and will correct or refund them when appropriate. Requests concerning duplicate or erroneous charges must be submitted through the account and billing contact method described above.

Expiration and non-renewal

A paid license provides commercial or organizational production-use permission and the applicable paid product, service, support, capacity, and feature entitlements through the end of its paid term. Successful renewal extends the signed license and those entitlements for the renewed annual term. If the subscription is canceled or does not renew, those paid permissions and entitlements end when the paid term expires, and the installation reverts to the capabilities available under the Personal tier. Continued commercial or organizational production use after expiration requires another valid paid license.

Cancellation, expiration, or non-renewal does not delete or require surrender of governance records or other customer-owned data retained locally by the customer. Core governance operation may continue and may record the installation's current license posture, subject to the Business Source License and its Additional Use Grant.

The stated BSL Change Date is May 13, 2030, and the Change License is the Apache License 2.0. The complete license text in the project repository is authoritative.

We are not liable for any damages arising from your use of Atested beyond the amount you have paid us in the twelve months preceding the event giving rise to the claim, except where such limitation is prohibited by law.

We may update these terms at any time. Continued use of Atested after an update constitutes acceptance of the updated terms. We will note the update date at the top of this page.

If a dispute arises, we agree to attempt resolution through good-faith negotiation before pursuing any formal action. These terms are governed by the laws of the State of Florida, United States.
